<a href="https://esstoragesv2.blob.core.windows.net/esstoragesv2/7140_348a.pdf">RTE Act 2009</a> <div class="headline-page"><h3>Eligibility</h3></div> <p style="text-align: justify;">The Rajasthan Government has issued notifications which specify: </p> <p style="text-align: justify;"><b>Weaker Section</b></p> <ul class="list-style-cus"> <li>Below Poverty Line families (both Central and state lists) prepared by the Rural/Urban Development Department of the State Government, and</li> <li>A child whose parents’ annual income does not exceed 2.5 Lakhs</li> </ul> <p style="text-align: justify;"><b>Disadvantage Group</b></p> <ul class="list-style-cus"> <li>Scheduled Caste (S.C.)</li> <li>Scheduled Tribe (S.T.)</li> <li>Other Backward Classes and Special Backward Classes whose parents' annual income does not exceed 2.5 lakhs</li> <li>A child covered under the definition of "person with disability" under clause (t) of section 2 of <u>PwD Act 1995 (1 to 1996)</u>.</li> </ul> <div class="headline-page"><h3>Method</h3></div> <p style="text-align: justify;">…… schools shall follow a system of random selection out of the applications received from children belonging to disadvantaged groups and weaker sections for filling per-determined number of seats in that class, which should not be less than 25% of the strength of that class.</p> <div class="headline-page"><h3>Entry Level</h3></div> <p style="text-align: justify;"><b>Que.</b> What is the entry level for admission of children in these 25% reserved free seats? </p> <p style="text-align: justify;"><b>Ans.</b> The Law explicitly states that:<br> "(unaided private schools) shall admit in class I…. and provide free and compulsory education till its completion, Provided further that where a school… imparts pre-school education, the provisions…shall apply for admission to such pre-school education"<br> So, the entry level for children in these free seats is either in CLASS1 at 6 years of age, or earlier at the PRE-SCHOOL level, if the school imparts pre-school education.</p> <p style="text-align: justify;"><b>Que.</b> For how many years will the child be entitled to free education in the private school?</p> <p style="text-align: justify;"><b>Ans.</b> The child will be entitled to free education till the completion of CLASS 8 at 14 years of age.</p> <p style="text-align: justify;"><b>Que.</b> Are disabled children also eligible under the 25% Free Reservation provision? </p> <p style="text-align: justify;"><b>Ans.</b> Yes, The 2012 RTE Act amendment has also included children with varying disabilities under the definition of disadvantage. Therefore, they are legally entitled to be included with children from other socio-economically disadvantaged groups for admission under the 25% free reservation quota.</p> <div class="headline-page"><h3>Admission Procedure</h3></div> <p style="text-align: justify;"><b>Que.</b> Which children are eligible to apply for the 25% reserved seats?</p> <p style="text-align: justify;"><b>Ans.</b> The Act specifies that admission in the seats should be offered to two categories of children defined as:<br> "Child belonging to <b>DISADVANTAGED GROUP</b> means a child belonging to the S.T., S.C., the socially and educationally backward class or such other group having other factor, as may be specified by the appropriate government, by notification:<br> "Child belonging to WEAKER SECTION means a child belonging to such parent or guardian whose annual income is lower than the minimum limit specified by the appropriate government, by notification:<br> Individual states and union territories have also issued rules which specify detailed eligibility criteria and family income limits for eligible children.<br> Colloquially, in common parlance all eligible children for the 25% reserved seats are also referred to as belonging to the "economically weaker section" (EWS).</p> <p style="text-align: justify;"><b>Que.</b> What is the admission procedure for these free seats to eligible children?</p> <p style="text-align: justify;"><b>Ans.</b> The Ministry of Human Resources Development on 23rd November 2010 issued detailed instructions in its Guidelines on Procedure for School Admission Under RTE Act, 2009 which specifies that<br> "…… schools shall follow a system of random selection out of the applications received from children belonging to disadvantaged groups and weaker sections for filling per-determined number of seats in that class, which should not be less than 25% of the strength of that class."</p> <div class="headline-page"><h3>No Capitation Fees</h3></div> <p style="text-align: justify;"><b>Que.</b> Can private schools charges capitation fees or "donations" at the time of admission?</p> <p style="text-align: justify;"><b>Ans.</b> No., The Act specified that for all children in all types of school:<br> "1. No school or Person shall, while admitting a child, collect any capitation fee…<br> 2. Any school person, if in contravention of the provisions…receives capitation fee, shall be punishable with FINE which may extend to ten times the capitation fee charged"<br> Individual states and union territories have also rules which specify the grievance redressal mechanism to lodge complaints.</p> <p style="text-align: justify;"><b>Note:</b> Children upto the age of three years residing in ward no. 30, 31, 32, 33, 34, 35 can procure forms from the school office and submit by 24 March, 2014, to be uploaded online.</p>
